Closing Process
What is a "closing?"
The closing is when the parties to a real estate contract come together to finalize the transaction. At closing, all required documents are executed, title is transferred and funds are collected and disbursed.
Information to provide prior to closing.
Buyer:
- Lender Information
- Homeowners insurance
- Termite Letter (if applicable)
- Home warranty (if applicable)
- Other applicable documents or special information i.e. tax return
Seller:
- Forwarding address and Georgia resident information
- Social Security number
- Payoff information for any liens against the property
- Condo or Homeowners' association information (if applicable)
- Copy of your Warranty Deed & Owner's Title Insurance policy (if available)
- Termite Letter (if applicable)
- Home warranty (if applicable)
- Other applicable documents or special information i.e. tax returns
Documents and Information Needed at the Closing
Buyer:
- Two forms of valid (non-expired) photo IDs i.e. driver's license, passport or other government issued ID
- Must wire any necessary funds required from lender (See link for wiring instructions)*Bring checkbook to closing in case you are required to pay more than the mount you sent via the wire transfer*
- Any documents required by your lender or the Law Offices of Kim Kline & Associates*Please confer with lender in advance for all required documents for closing*
- If buyers are requesting additional parities to be added to warranty deed, please confer with lender in advance additional costs may be imposed.
Seller:
- A valid (non-expired) photo IDs i.e. driver's license, passport or other government issued ID
- Any home related items for the buyers i.e. house keys, garage door openers, security codes.
- Any documents required by your lender or the Law Offices of Kim Kline & Associates *Please confer with lender in advance for all required documents for closing*
Time and place of closing
The expected timeframe of a closing is 1 hour. The closing will take place at The Law Offices of Kim Kline & Associates where our attorneys will explain the closing documents and answer all of your questions.
Power of Attorney Process
- Individual giving power of attorney contacts The Law Office of Kim Kline & Associates.Phone call only, email, fax or other form of communication can not be accepted.
- The Power of Attorney document will be drafted and sent with instructions on how to execute power of attorney. A FedEx return label will be provided to ensure secure return of all documents.
- Individual giving power of attorney must go to a notary and sign power of attorney documents in front of the notary and a separate witness (not the person they are giving power of attorney to)
- Power of Attorney documents must be signed in blue ink only.
- Once the document has been executed, return the documents to the office using the pre-paid FedEx return label
- The Law Office of Kim Kline and Associates will record it with the clerk of court if necessary.
